Gir\u0117no g. 42A, LT-02189 Vilnius (\u201cCircle Link,\u201d \u201cwe,\u201d \u201cour,\u201d or \u201cus\u201d).<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">\u201cYou\u201d or \u201cyour\u201d refers to the individual or legal entity using the Service. If you are using the Service on behalf of a company or organization, you confirm that you are authorized to accept these terms on its behalf.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">The Service is currently offered free of charge. It is provided \u201cas is,\u201d without guarantees or warranties. Use of the Service<\/strong><\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">By using the Service, you agree to:<\/p><ol class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\"><li class=\"framer-text\"><p class=\"framer-text\"><strong class=\"framer-text\">Use the Service in good faith and solely for its intended purpose<\/strong> \u2014 namely, to plan your own electric vehicle (EV) routes and charge your vehicle at public charging stations.<\/p><\/li><li class=\"framer-text\"><p class=\"framer-text\"><strong class=\"framer-text\">Comply with all applicable laws, rules, and terms of use<\/strong> set forth by Circle Link or any of its partners, suppliers, or connected service providers.<\/p><\/li><li class=\"framer-text\"><p class=\"framer-text\"><strong class=\"framer-text\">Keep your login credentials secure<\/strong>, and not share your account with others. You are fully responsible for all activities that occur under your account unless you have previously notified us of a security breach.<\/p><\/li><li class=\"framer-text\"><p class=\"framer-text\"><strong class=\"framer-text\">Notify us immediately if you suspect any unauthorized use<\/strong> of your account or a potential breach of the Service&#8217;s security.<\/p><\/li><li class=\"framer-text\"><p class=\"framer-text\"><strong class=\"framer-text\">Not misrepresent your identity or impersonate others<\/strong> while using the Service.<\/p><\/li><li class=\"framer-text\"><p class=\"framer-text\"><strong class=\"framer-text\">Not interfere with or disrupt the Service<\/strong>, servers, or networks connected to it, including attempting to gain unauthorized access or introduce harmful code (such as malware, bots, or scraping tools).<\/p><\/li><li class=\"framer-text\"><p class=\"framer-text\"><strong class=\"framer-text\">Respect the community by using the Service in a lawful and responsible manner<\/strong>, and only for personal or internal business purposes.<\/p><\/li><li class=\"framer-text\"><p class=\"framer-text\"><strong class=\"framer-text\">Only submit content (such as reviews, station comments, or feedback) that is truthful, accurate, and respectful<\/strong>. You may not post misleading, defamatory, discriminatory, offensive, or otherwise unlawful content.<\/p><\/li><li class=\"framer-text\"><p class=\"framer-text\"><strong class=\"framer-text\">Accept full responsibility for any content you submit or share via the Service<\/strong>, including ensuring that you have the legal right to publish it and that it complies with these Terms of Use. Your Responsibility for Your Account<\/strong><\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">If you choose to create an account on the Service, you are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">You must not share your account or allow others to access the Service using your credentials unless a specific feature allows for authorized multi-user or team access. Your Content<\/strong><\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">As part of using the Service, you may submit or transmit various forms of content, including but not limited to charging station reviews, usage feedback, vehicle data, preferences, photos, or location information (collectively, <strong class=\"framer-text\">\u201cUser Content\u201d<\/strong>).<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\"><strong class=\"framer-text\">5.1 Your Responsibility and Representations<\/strong><\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">By submitting User Content through the Service, you represent and warrant that:<\/p><ul class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\"><li class=\"framer-text\"><p class=\"framer-text\">You own or control all necessary rights to the content or have obtained the appropriate permissions;<\/p><\/li><li class=\"framer-text\"><p class=\"framer-text\">Your content is truthful, relevant, non-defamatory, and does not infringe on any intellectual property, privacy, or contractual rights of others;<\/p><\/li><li class=\"framer-text\"><p class=\"framer-text\">Your content complies with applicable laws and is not offensive, misleading, obscene, threatening, or otherwise objectionable.<\/p><\/li><\/ul><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">You are solely responsible for any User Content you submit. Circle Link does not guarantee the accuracy, integrity, or quality of any content shared by users, and disclaims any liability for such content.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\"><strong class=\"framer-text\">5.2 License to Use Your Content<\/strong><\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">By posting, uploading, or otherwise submitting User Content, you grant <strong class=\"framer-text\">Circle Link<\/strong> a <strong class=\"framer-text\">worldwide, royalty-free, non-exclusive, irrevocable, perpetual, transferable and sublicensable license<\/strong> to use, copy, reproduce, adapt, modify, translate, publish, perform, display, distribute, and make derivative works from that content in connection with the operation, development, or promotion of the Service, in any media format and through any media channels.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">This license remains in effect even if you stop using the Service or delete your content, unless you specifically request removal and we are legally permitted and technically able to do so.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\"><strong class=\"framer-text\">5.3 Moderation and Removal<\/strong><\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">Circle Link reserves the right, but not the obligation, to review, moderate, edit, or delete User Content at its sole discretion, including but not limited to cases where the content:<\/p><ul class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\"><li class=\"framer-text\"><p class=\"framer-text\">Violates these Terms or any applicable law;<\/p><\/li><li class=\"framer-text\"><p class=\"framer-text\">Is false, harmful, misleading, or abusive;<\/p><\/li><li class=\"framer-text\"><p class=\"framer-text\">Contains inappropriate language or spam;<\/p><\/li><li class=\"framer-text\"><p class=\"framer-text\">Harms the reputation of charging station operators, users, or Circle Link.<\/p><\/li><\/ul><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">Circle Link also reserves the right to suspend or terminate accounts that repeatedly or egregiously violate these guidelines.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\"><strong class=\"framer-text\">5.4 Community Transparency and Visibility<\/strong><\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">Certain forms of User Content (e.g. reviews, tips, error reports) may be publicly visible to other users. By submitting such content, you understand that:<\/p><ul class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\"><li class=\"framer-text\"><p class=\"framer-text\">Other users may view, respond to, or rely on your submissions;<\/p><\/li><li class=\"framer-text\"><p class=\"framer-text\">Circle Link may aggregate and display community-sourced information (e.g., best-rated chargers, most reported issues) for the benefit of users;<\/p><\/li><li class=\"framer-text\"><p class=\"framer-text\">Your display name or anonymized identifier may be shown alongside your submissions.<\/p><\/li><\/ul><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">You are advised not to include personal or sensitive data in areas intended for public use. Circle Link assumes no liability for damages resulting from disclosure of such information submitted by you.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\"><strong class=\"framer-text\">5.5 Reporting Violations<\/strong><\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">If you believe that certain User Content is unlawful, abusive, or violates your rights, you may report it to <a class=\"framer-text framer-styles-preset-xfwwyj\" href=\"mailto:support@circlelink.app\" rel=\"noopener\" data-styles-preset=\"MGZphnYHX\"><strong class=\"framer-text\">support@circlelink.app<\/strong><\/a>. Privacy and Data Use<\/strong><\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">We respect your privacy. By using the Service, you acknowledge and agree that certain personal data may be collected and processed as necessary to provide and improve the Service.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">We aim to minimize the amount of personal data we collect. Examples may include your name, email address, charging session data, and basic vehicle preferences. We do not sell personal data, and we do not access your contacts or social media information.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">Use of the Service via social login (Google, Apple) gives us access only to your basic profile information (name and email). You can revoke access at any time via your Google or Apple account settings.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">Your data may be shared with trusted partners (such as EV charging operators or infrastructure providers) only when necessary to enable charging or support technical operations. We only share data in accordance with applicable data protection laws.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">Personal data is stored only as long as necessary to provide the Service and fulfill our legal obligations. Limitation of Liability<\/strong><\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">To the fullest extent permitted by law, Circle Link shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages, including but not limited to loss of data, profit, revenue, or business interruption arising out of or in connection with:<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">1.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 the use or inability to use the Service,<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">2.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 third-party system outages or API issues (e.g. EV charging providers),<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">3.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 inaccuracies or delays in location, map or charging information,<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">4.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 data loss, technical bugs, or security incidents beyond our reasonable control.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">Use the Service at your own risk and with appropriate caution.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\"><strong class=\"framer-text\">11. Fees and Charges<\/strong><\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">Use of the Circle Link application is subject to a <strong class=\"framer-text\">service fee of 4% per EV charging session<\/strong>. This fee is calculated based on the total amount charged by the charging station operator and is automatically included in your final payment at the time of the transaction. <strong class=\"framer-text\">A minimum service fee of \u20ac0.50 applies<\/strong>, if the calculated 4% fee would result in a lower amount.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">\u00a0Circle Link <strong class=\"framer-text\">does not own or operate<\/strong> any charging stations. It facilitates access to third-party charging infrastructure and processes payments on behalf of users. By initiating a charging session via the app, you authorize the application of this service fee and agree to pay any additional fees or rates set by the respective charging station operator.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">\u00a0\u26a0\ufe0f <em class=\"framer-text\">Circle Link is not responsible for any pricing inaccuracies or structural breakdowns of third-party charging station fees. Users are solely responsible for reviewing and accepting the displayed pricing details before confirming any session.<\/em><\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">\u00a0For sessions using the <strong class=\"framer-text\">fixed-charge feature<\/strong>, the system will <strong class=\"framer-text\">pre-authorize an additional 10% amount<\/strong> on top of the selected charging sum. This temporary buffer helps ensure smooth settlement in case of minor price fluctuations by the operator. The unused portion of the reserved amount is automatically refunded to the user <strong class=\"framer-text\">immediately after the session ends<\/strong>.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">\u00a0Circle Link does not currently offer subscription plans or recurring billing. Should such features be introduced in the future, users will be notified in advance.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">\u00a0Circle Link reserves the right to introduce new features or pricing models in the future, including\u2014but not limited to\u2014<strong class=\"framer-text\">subscription plans, premium tiers, or differentiated service levels<\/strong>. By using the Service, you acknowledge and agree that such changes may occur and that continued use of the application may be subject to updated terms and pricing structures.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">By initiating a charging session through the app, you authorize the application of this service fee and agree to any charges set by the third-party charging station operator. You are responsible for reviewing and accepting those costs before confirming the charging session.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">You are responsible for any costs incurred through your use of third-party charging stations accessed via the Service. Circle Link facilitates access and transaction processing but is not the owner or operator of the charging infrastructure.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\"><strong class=\"framer-text\">12. Changes to or Cancellation of the Service<\/strong><\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">Circle Link reserves the right to modify, update, suspend, or discontinue any part of the Service at any time, for any reason, with or without prior notice. This may include changes to features, availability, design, functionality, or third-party integrations.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">We are not responsible for any losses, damages, or data unavailability resulting from such modifications or interruptions, whether temporary or permanent.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">In line with our data retention policy, we may delete account-related data that has not been accessed for a specified period (currently up to 3 months) after the termination or inactivity of your account.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\"><strong class=\"framer-text\">13. Interpretation<\/strong><\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">If any provision of these Terms of Use is found to be unenforceable or invalid under applicable law by a court of competent jurisdiction, that provision shall be replaced by a valid and enforceable term that most closely reflects the original intent. Cancellation and Termination of the Service<\/strong><\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">You may stop using the Service at any time by uninstalling the Circle Link mobile application from your device. If you have registered an account, you may also request its deletion by contacting us at <a class=\"framer-text framer-styles-preset-xfwwyj\" href=\"mailto:support@circlelink.app\" rel=\"noopener\" data-styles-preset=\"MGZphnYHX\">support@circlelink.app<\/a>.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">As Circle Link currently does not offer paid subscriptions, no cancellation process via app store platforms is required. If any premium features are introduced in the future, the applicable terms of the App Store or Google Play Store will apply to subscription management and cancellation.<\/p><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">Circle Link reserves the right, at its sole discretion, to suspend, restrict, or terminate your access to the Service, temporarily or permanently, in the following cases:<\/p><ul class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\"><li class=\"framer-text\"><p class=\"framer-text\">If you breach these Terms of Use;<\/p><\/li><li class=\"framer-text\"><p class=\"framer-text\">If you violate applicable laws or third-party terms (e.g., OCPI-linked operators);<\/p><\/li><li class=\"framer-text\"><p class=\"framer-text\">If your account is inactive for a prolonged period;<\/p><\/li><li class=\"framer-text\"><p class=\"framer-text\">If Circle Link discontinues or materially alters the Service.<\/p><\/li><\/ul><p class=\"framer-text framer-styles-preset-esge6j\" data-styles-preset=\"bHH7nlzrA\">We may retain your personal data and service usage records for up to <strong class=\"framer-text\">three (3) months<\/strong> following the deletion of your account or your last activity on the Service. After this period, such data may be <strong class=\"framer-text\">permanently deleted or anonymized<\/strong>, unless we are legally required to retain it longer for compliance, fraud prevention, or dispute resolution purposes. Dariaus ir S.
